USA Notary provides a remote online notarization (RON) platform connecting licensed notaries with signers for electronic notarization of documents. We also offer subscription plans for notaries including marketing pages, scheduling tools, and business management features.

USA Notary is a technology platform provider, not a notary public. Notarial acts are performed by independently licensed notaries using our platform in compliance with applicable state laws.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must be at least 18 years of age to use the Platform
  • You may not share your account with others or transfer your account
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Identity Verification

All signers must complete identity verification (IDV) and, when required, knowledge-based authentication (KBA). You consent to the collection and verification of your personal information, including government ID documents and biometric data, for this purpose. Failure to pass identity verification may result in session cancellation.

5. Subscription Plans and Payments

  • Subscription fees are billed monthly in advance
  • Session fees are charged per notarization based on your plan
  • IDV and KBA fees are additional per session
  • All fees are non-refundable except as required by law
  • We reserve the right to modify pricing with 30 days' notice
  • Failed payments may result in account suspension

6. Notary Responsibilities

Notaries using the Platform are responsible for:

  • Maintaining valid notary commission and RON authorization in their state
  • Complying with all applicable notarial laws and regulations
  • Verifying signer identity per state requirements
  • Maintaining required notarial records and journals
  • Ensuring the legality and appropriateness of documents notarized

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or fraudulent activity
  • Impersonate another person or provide false information
  • Interfere with or disrupt the Platform's operation
  • Attempt to circumvent identity verification or platform security
  • Upload malicious code or content
  • Record sessions through external means without all parties' consent

8. Intellectual Property

All content, trademarks, logos, and technology on the Platform are owned by USA Notary or licensed to us. You may not copy, modify, distribute, or create derivative works without our express written permission. Notary profile pages and uploaded content remain the property of the respective notary, subject to a license for Platform display.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, USA NOTARY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

USA Notary is not liable for the conduct of notaries or signers, the validity of notarized documents, or any legal consequences arising from notarization performed on the Platform.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure. We make no representations regarding the legal sufficiency of documents notarized through the Platform.

11. Indemnification

You agree to indemnify and hold harmless USA Notary, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these terms, or violation of applicable laws.

12. Third-Party Services

The Platform integrates with third-party services including identity verification providers, payment processors, and scheduling tools. We are not responsible for the availability, accuracy, or practices of these third-party services.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for violation of these terms. Upon termination, your right to use the Platform ceases. Data retention obligations under notarial laws survive termination.

Important: USA Notary uses SMS/MMS text messaging only for appointment notifications and reminders. We do not send marketing or promotional text messages. These terms apply to all text communications delivered via Twilio. By providing your phone number and opting in, you agree to these terms.

1. Program Description

USA Notary ("we," "us," or "our") offers an SMS messaging program ("the Program") strictly for appointment-related communications with customers. Messages are limited to:

  • Appointment confirmations and scheduling notifications
  • Upcoming appointment reminders
  • Time-sensitive appointment-related updates

We do not use SMS for marketing, promotional offers, or any purpose unrelated to your scheduled appointments. Message frequency varies based on your appointment activity.

2. Opt-In / Consent

By providing your mobile phone number to USA Notary, you expressly consent to receive SMS/MMS messages from USA Notary using automated technology, including auto-dialers, solely for appointment-related notifications. You acknowledge that:

  • Consent to receive appointment messages is not a condition of purchase
  • Standard message and data rates from your mobile carrier may apply

  • You will immediately notify us if you change or deactivate your mobile number

3. Opt-Out / STOP Instructions

4. Message & Data Rates

Message and data rates may apply from your mobile carrier. USA Notary does not charge for text messages, but your carrier's standard messaging, data, and other rates may apply. Check your mobile plan for details. You are solely responsible for any charges from your mobile carrier.

5. Supported Carriers

Our SMS program is supported by major U.S. mobile carriers including, but not limited to: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, and Virgin Mobile. USA Notary and Twilio are not liable for delayed or undelivered messages due to carrier issues.

6. Message Frequency

The number of messages you receive will depend on your appointment activity. Messages are limited to appointment confirmations, reminders, and urgent appointment-related updates. You will not receive marketing or promotional messages via SMS.

7. Privacy & Data Use

Your mobile number and message data are handled in accordance with our Privacy Policy. We do not sell, rent, or share your mobile number with third parties for their own marketing purposes. Message content and metadata may be stored for compliance and operational purposes.

8. Age Restrictions

You must be at least 18 years of age to opt into our SMS program. We do not knowingly collect phone numbers or send messages to individuals under 18.

9. Service Provider

11. Limitation of Liability

USA Notary is not responsible for any delays, non-delivery, or errors in SMS messages caused by your mobile carrier, Twilio, network congestion, or technical issues beyond our reasonable control. We are not liable for any damages arising from or related to your participation in the SMS program.
